Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and device settings.

You can opt out at any time by replying STOP to any message. After opting out, you may receive one final message confirming your opt-out.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALMOND TREE SENIOR CARE, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM (WHICHEVER IS GREATER), UNLESS APPLICABLE LAW REQUIRES OTHERWISE.

You agree to defend, indemnify, and hold harmless Almond Tree Senior Care, LLC and its owners, officers, employees, contractors, and agents from and against any claims, damages, liabilities, losses, and expenses (including attorneys' fees) arising from or related to:

• Your violation of any law or third-party right
• Any content or information you submit through the Services

If arbitration is not enforceable, disputes will be brought exclusively in the state or federal courts located in Arapahoe County, Colorado, and you consent to personal jurisdiction and venue there.
